This agreement governs all aspects of the SkyGround digital ecosystem. By accessing our servers, you accept these conditions in full without exception.
1. SUBSCRIPTION & FINANCIALS
1.1 Irrevocable Fees
All subscription fees, including monthly and annual plans, are strictly non-refundable once the training content has been accessed. SkyGround does not provide pro-rata refunds for partially used periods.
1.2 Price Adjustments
SkyGround reserves the absolute right to adjust subscription rates at any time. Active subscribers will be notified, and continued use of the service constitutes acceptance of new rates.
1.3 Automatic Renewals
All plans renew automatically. Cancellation must be performed at least 48 hours prior to the next billing cycle via the dashboard. SkyGround is not responsible for forgotten cancellations.
1.4 Payment Failures
Failure to process a payment results in immediate account suspension. SkyGround is not liable for any training progress lost or exam readiness decay during periods of suspension.
2. INTELLECTUAL PROPERTY & USAGE
2.1 Database Ownership
Our question bank, explanations, and imagery are protected under international copyright. Any attempt to scrape, download, or distribute content results in a permanent ban and legal action.
2.2 Derived Insights
By using the platform, you grant SkyGround a perpetual, irrevocable license to use your anonymized study data to improve our algorithms and commercial analytics.
2.3 White-Label Restrictions
Institutional accounts must adhere strictly to branding guidelines. Unauthorized modification of the interface or removal of SkyGround logos is a breach of contract.
2.4 Account Sharing
Accounts are restricted to a single individual. Our systems monitor HWID (Hardware IDs) and IP patterns. Detected sharing results in instant termination without refund.
3. OPERATIONAL DISCLAIMERS
3.1 Zero Accuracy Warranty
While we strive for technical excellence, SkyGround provides its content 'AS IS'. We do not guarantee that the database reflects the exact current state of official exam questions.
3.2 Exam Outcomes
SkyGround is a training aid. We accept zero liability for any exam failure, financial loss, or career delays resulting from the use or misuse of our materials.
3.3 Authority Primacy
The official AFM (Aircraft Flight Manual) and NAA (National Aviation Authority) publications always take precedence over SkyGround content. Do not fly based on SkyGround logic.
3.4 Service Disruptions
While we target 99.9% uptime, we are not liable for outages caused by upstream providers (AWS/Supabase) or necessary emergency maintenance.
4. TERMINATION & INDEMNITY
4.1 Right to Terminate
SkyGround reserves the right to terminate any user's access for any reason, at our sole discretion, without prior notice or refund of remaining time.
4.2 User Indemnity
You agree to indemnify and hold SkyGround Systems ASA harmless from any claims, losses, or legal fees arising from your breach of these terms.
4.3 Exclusive Jurisdiction
All legal proceedings must be initiated in the courts of Oslo, Norway. Use of the service implies a waiver of any right to pursue class-action lawsuits.
4.4 Agreement Updates
These terms may be updated without individual notice. Your continued login constitutes a legally binding acceptance of the most current version.
89. Final Discretionary Clause
SkyGround Systems ASA reserves the absolute and final right to interpret these terms in its own favor in the event of any ambiguity or legal dispute. Use of this training platform implies a complete and unconditional waiver of any right to challenge the technical or commercial decisions of the SkyGround executive board.
